Terms of Service

These Terms of Service govern your access to and use of Rexenda. By creating an account or using the service, you agree to these terms. Please read them carefully; if you are accepting on behalf of an organization, you confirm that you are authorized to bind it.

The service

Rexenda is a cloud platform that unifies customer conversations across channels and adds AI assistance, lead management and reporting. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and your subscription plan.

Accounts and eligibility

You must provide accurate information, keep your credentials secure and be responsible for all activity under your account. You must be at least 18 years old and legally able to enter into a contract. You are responsible for your team members' use of the service.

Acceptable use

You agree to use Rexenda lawfully and not to send spam or unsolicited messages, infringe others' rights, distribute malware, attempt to disrupt or reverse-engineer the service, or use it for unlawful, deceptive or harmful purposes. You must comply with the rules of any third-party channels you connect (such as messaging and telephony providers) and with applicable anti-spam and communications laws.

Your data and responsibilities

You retain ownership of the data you and your contacts submit. You are responsible for having a valid legal basis and, where required, consent to process your contacts' personal data through Rexenda, and for honoring their privacy rights. We process this data on your behalf as described in our Privacy Notice and data processing agreement.

AI features

AI-generated suggestions and content are provided to assist you and may be inaccurate or incomplete. You are responsible for reviewing AI output before relying on or sending it, and it should not be treated as legal, financial or professional advice.

Plans, fees and billing

The Free plan is available with no time limit, subject to the limits published for it. Paid plans are billed in advance, monthly or yearly according to the plan you select, through our payment provider, and renew automatically until cancelled. Fees include applicable taxes. AI credits and usage-based items, such as voice minutes, SMS, phone numbers and e-invoice stamps, are billed as described in the application. WhatsApp fees are charged by Meta directly to your own WhatsApp Business Account and are not billed by Rexenda. Except where required by law, payments are non-refundable. You can cancel or move to a lower plan at any time; the change takes effect at the end of the current billing period, and you retain access until then.

Intellectual property

Rexenda, its software, brand and content are owned by BENDDI TECHNOLOGIES S.A. DE C.V. and its licensors and are protected by law. These terms grant you no rights to our intellectual property other than the limited right to use the service.

Warranties and disclaimers

We work hard to keep Rexenda reliable and secure, but the service is provided on an 'as is' and 'as available' basis without warranties of any kind to the maximum extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free or that it will meet every requirement. This does not exclude any rights you have as a consumer that cannot be waived under applicable law.

Limitation of liability

To the maximum extent permitted by law, Rexenda and BENDDI TECHNOLOGIES will not be liable for indirect, incidental or consequential damages, or for lost profits or data, and our total liability for any claim is limited to the amount you paid for the service in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

Term, suspension and termination

These terms apply while you use the service. You may stop using Rexenda and close your account at any time. We may suspend or terminate access if you materially breach these terms or use the service in a way that creates risk or legal exposure. On termination we will make your data available for export for a reasonable period, after which we may delete it.

Governing law and contact

These terms are governed by the laws of Mexico, without prejudice to the mandatory consumer-protection rights you may have in your country of residence. If any provision is found unenforceable, the rest remains in effect. For any questions about these terms, contact us at [email protected].
